Terms of Service
1. ACCEPTANCE OF TERMS
By engaging Cornerstone Property Services LLC (“Cornerstone,” “we,” “us,” or “our”) for excavation, drainage, grading, or related services, you (“Client,” “you,” or “your”) agree to these Terms of Service. If you do not agree to these terms, do not proceed with our services.
2. SERVICES PROVIDED
Cornerstone provides excavation, drainage installation, gravel driveway work, land grading, site preparation, and related property services across Marquette County and surrounding Upper Peninsula areas. Specific services will be outlined in written estimates and project agreements.
3. ESTIMATES AND PRICING
3.1 Free Estimates We provide free on-site estimates for projects within our service area. Estimates are valid for 30 days from the date provided.
3.2 Pricing Final pricing may vary from initial estimates if site conditions differ from what was observed during the estimate, additional work is requested, or unforeseen complications arise. We will notify you of any significant price changes before proceeding with additional work.
3.3 Changes to Scope Any changes to the agreed-upon scope of work must be approved in writing and may result in additional charges.
4. PAYMENT TERMS
4.1 Deposit A deposit is required before work begins. Deposit amounts will be specified in the project estimate or agreement.
4.2 Payment Schedule Payment terms will be outlined in the project agreement. Final payment is due upon project completion unless otherwise agreed in writing.
4.3 Late Payment Late payments may be subject to interest charges of 1.5% per month (18% annually) or the maximum rate permitted by Michigan law, whichever is lower.
5. CLIENT RESPONSIBILITIES
5.1 Property Access Client must provide clear access to the work site and ensure all necessary permits are obtained prior to work beginning.
5.2 Utility Location Client is responsible for contacting Michigan’s MISS DIG service (811) to mark underground utilities before excavation work begins. Cornerstone is not responsible for damage to unmarked utilities.
5.3 Site Conditions Client must disclose any known site conditions that may affect the work, including underground utilities, septic systems, wells, buried debris, contaminated soil, or unstable ground.
5.4 Property Damage Client is responsible for protecting personal property, landscaping, and structures not directly involved in the work. Cornerstone will make reasonable efforts to minimize impact to surrounding areas.
6. WARRANTIES AND LIMITATIONS
6.1 Workmanship Warranty We warrant that our work will be performed in a professional manner consistent with industry standards. This warranty covers defects in our workmanship for a period of one year from project completion.
6.2 Materials Materials are warranted by their respective manufacturers. We do not provide warranties beyond those provided by material suppliers.
6.3 Exclusions Our warranty does not cover damage caused by:
- Natural events (flooding, erosion, freeze-thaw beyond normal conditions)
- Client modifications or subsequent work by others
- Failure to maintain drainage systems or surfaces
- Normal wear and tear
- Underground conditions not discoverable during initial site assessment
6.4 No Guarantee of Results While we use professional methods and quality materials, we cannot guarantee specific outcomes regarding drainage performance, soil stability, or other site-specific results due to variables beyond our control.
7. LIABILITY LIMITATIONS
7.1 Insurance Cornerstone maintains general liability insurance for excavation operations. Proof of insurance is available upon request.
7.2 Limitation of Liability To the maximum extent permitted by law, our total liability for any claim arising from our services shall not exceed the amount paid by Client for the specific services giving rise to the claim.
7.3 Underground Conditions We are not liable for damage to unmarked underground utilities, undisclosed septic systems, buried debris, or other hidden site conditions not reasonably discoverable during the estimate process.
7.4 Weather and Delays We are not liable for project delays caused by weather, site conditions, permit issues, utility conflicts, or other circumstances beyond our reasonable control.
8. CANCELLATION AND REFUNDS
8.1 Client Cancellation Client may cancel services before work begins with written notice. Deposits may be non-refundable if materials have been ordered or scheduling commitments have been made.
8.2 Our Cancellation We reserve the right to cancel or refuse service if site conditions are unsafe, permits are not obtained, payment terms are not met, or Client fails to meet their responsibilities under these terms.
9. PERMITS AND COMPLIANCE
Client is responsible for obtaining all necessary permits for the work unless specifically agreed otherwise in writing. We will perform work in accordance with applicable local, state, and federal regulations.
10. DISPUTE RESOLUTION
10.1 Governing Law These terms are governed by the laws of the State of Michigan.
10.2 Disputes Any disputes arising from these terms or our services shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in Marquette County, Michigan, or through the courts of Marquette County, Michigan.
11. INDEMNIFICATION
Client agrees to indemnify and hold harmless Cornerstone Property Services LLC, its owner, and employees from any claims, damages, or expenses arising from:
- Client’s failure to disclose site conditions
- Client’s failure to obtain necessary permits
- Client’s failure to mark underground utilities
- Client’s modifications to completed work
- Third-party claims related to property access or boundaries
12. MODIFICATIONS TO TERMS
We reserve the right to modify these Terms of Service at any time. Updated terms will be posted on our website with the revision date. Continued use of our services after changes constitutes acceptance of modified terms.
13. ENTIRE AGREEMENT
These Terms of Service, together with any written project agreements or estimates, constitute the entire agreement between Client and Cornerstone Property Services LLC regarding the services provided.
14. SEVERABILITY
If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
